People have had sewage issues due to trees that they are supposed to be caring for and they won’t reimburse homeowners. The HOA board does nothing. They will even tell you that but they are consistently raising fees. They selectively enforce rules on certain homeowners. When you have issues, they also do not relay any information about how they addressed the homeowners issues. STEER CLEAR AWAY FROM THEM. Had I known they were this bad I would’ve never bought a home here

Q1:What law governs New Jersey HOAs?

New Jersey HOAs are governed by the New Jersey Planned Real Estate Development Full Disclosure Act (N.J.S.A. 45:22A-21 et seq.) and the New Jersey Condominium Act (N.J.S.A. 46:8B-1 et seq.).

Q2:Can a New Jersey HOA ban solar panels?

No. New Jersey law (N.J.S.A. 45:22A-48.2) prohibits HOAs from unreasonably restricting the installation of solar panels. HOAs may impose reasonable aesthetic conditions but cannot effectively prevent installation.

Q3:Does New Jersey offer a way to resolve HOA disputes outside of court?

Yes. The New Jersey Department of Community Affairs (DCA) offers a complaint process and the state has a Planned Real Estate Development Ombudsman to handle HOA-related disputes.
