HOAs in Delaware
Burnbrae Condominiums
New Castle, Delaware
Worst HOA ever.
Worst HOA ever. If you see a property with this company as your HOA.......RUN! Unless you wanted to be under martial law......avoid this association at all costs. Neighbors are great, Landlords are great but the HOA is the absolute worst. They knit pick about everything under the sun and the staff is completely unprofessional. Living under this HOA is like living under martial law with a tyrant. They act like they are GOD almighty. DONT DO IT.
FAQ
Delaware HOA Questions
Q1:What statute governs HOAs in Delaware?
Delaware's Unit Property Act governs condominiums, while the Delaware Planned Community Act (6 Del. C. § 81-101 et seq.) governs planned HOA communities formed after 2009.
Q2:Can a Delaware HOA charge interest on late assessments?
Yes. Delaware law permits HOAs to charge interest on overdue assessments at the rate specified in the community's governing documents, typically up to a statutory maximum.
Q3:Do Delaware HOA members have the right to vote on rule changes?
It depends on the governing documents. Major changes to CC&Rs typically require member votes, while the board may amend rules and regulations without a member vote under most Delaware HOA structures.
