My experience with the Swiftwater HOA has been overwhelmingly negative, culminating in a lawsuit that should never have been necessary. What should have been a simple architectural request turned into a multi‑year conflict driven by inconsistent standards, shifting explanations, and a complete lack of written rules. 1. No Written Standards & Arbitrary Decisions The core issue began when I applied to install a paver driveway, an upgrade that is common, attractive, and fully compliant with city code. The HOA denied my application despite having no written driveway standard, no published criteria, and no documented process. Their reasoning changed multiple times: aesthetics, “uniformity,” city code, and even invented terms like a “feathered driveway standard,” which does not exist in any municipal or engineering context. 2. Governance Problems During this period, the HOA conducted a disputed board election involving secret ballots and procedural irregularities. This made it even harder to trust the decision‑making process or believe that my application was being handled fairly. 3. Forced Into Litigation Because the HOA had no written standards, no consistent process, and no willingness to engage constructively, I had no choice but to pursue legal action. Litigation is expensive and stressful, and it should be a last resort, but the HOA left me with no alternative. Even during settlement discussions, the HOA attempted to tie my driveway approval to a community‑wide rulemaking process and a membership vote, instead of simply resolving the issue directly. 4. A Community That Deserves Better Governance Swiftwater is a beautiful neighborhood with great homes and great people. Unfortunately, the HOA’s governance practices do not match the quality of the community. Homeowners deserve clear written standards, consistent enforcement, transparent elections, and a board that follows its own governing documents. 5. My Recommendation If you are considering moving into Swiftwater, be aware that the HOA may apply unwritten or subjective standards to your property, and you may face inconsistent or arbitrary decisions. Document everything, ask for written rules, and be prepared for a slow and unpredictable approval process. My hope is that the community eventually adopts clear, objective standards and improves its governance. Until then, my experience has been that Swiftwater HOA is not operating in a fair, transparent, or homeowner‑friendly manner.
